Terms and Conditions of Concert Attendance

  1. Definitions
    1. “Presenter” shall mean and refer to 54 Entertainment, subsidiary, affiliates or any appointed agent, the legal entity responsible for organizing and hosting the event, and shall include its employees, agents, representatives, contractors, and affiliates. 
    2. “Ticket Holder” shall mean and refer to the individual or entity who has purchased, acquired, or otherwise obtained a valid ticket to attend the event, including their guests, successors, and assigns.
    3. “Event” shall mean and refer to the concert, live performance, or other entertainment experience for which the ticket has been issued, as described on the ticket or other official promotional materials.
    4. “Ticket Vendor” shall mean and refer to the entity or platform through which the Ticket Holder purchased the ticket, such as a ticketing agency, website, or box office.
  2. Ticket Purchase, Ownership, and Limitations
    1. All ticket purchases, transfers, and refunds shall be subject to the terms and conditions set forth by the Ticket Vendor. The Presenter shall not be responsible for any issues, disputes, or liabilities arising from ticket transactions, and the Ticket Holder agrees to hold the Presenter harmless from any such claims.
    2. The Ticket Holder acknowledges and agrees that the Ticket Vendor’s terms and conditions shall govern all aspects of ticket ownership, including but not limited to resale restrictions, transfer policies, and maximum purchase limits.
    3. The Presenter, at its sole discretion, reserves the right to limit the number of tickets that may be purchased per person, per credit card, per household, or per transaction. Any tickets purchased in excess of such limits may be canceled without notice or refund, and the Presenter shall not be liable for any consequential damages or losses arising from such cancellation.
  3. Refunds, Exchanges, and Cancellations
    1. All refunds, exchanges, and cancellations shall be handled exclusively by the Ticket Vendor in accordance with their terms and conditions. The Presenter shall not be responsible for processing or issuing any refunds, exchanges, or credits, regardless of the reason for the request. 
    2. In the event of a cancellation, postponement, or rescheduling, the Ticket Vendor may, at its discretion and in accordance with its terms and conditions, offer refunds, exchanges, or credits. The Presenter shall not be liable for any failure or delay by the Ticket Vendor in providing such remedies.
    3. The Presenter reserves the right to cancel, reschedule, or modify the event at any time, for any reason, without notice or liability, including but not limited to cases of force majeure, safety concerns, technical difficulties, or other circumstances beyond the Presenter’s reasonable control.
  4. Lost or Stolen Tickets 
    1. The Presenter shall not be held liable for any lost, stolen, or destroyed tickets, regardless of the circumstances leading to such loss, theft, or destruction. It shall be the sole responsibility of the Ticket Holder to contact the Ticket Vendor to seek any available remedies, which may include ticket replacement, subject to the Ticket Vendor’s terms, conditions, and policies. The Presenter shall not be obligated to issue replacement tickets or provide any compensation for lost, stolen, or destroyed tickets.
  5. Parking and Transportation
    1. The Presenter may, at its sole discretion, provide information regarding parking availability, fees, and any third-party partnerships with ride-sharing or public transportation services. However, the Presenter makes no representations or warranties as to the accuracy, completeness, or reliability of such information. The Ticket Holder acknowledges and agrees that the Presenter shall not be liable for any issues, damages, or losses arising from parking or transportation, including but not limited to vehicle damage, theft, or personal injury. The Ticket Holder assumes all risks associated with parking and transportation related to the event.
  6. Prohibited Items
    1. The Ticket Holder acknowledges and agrees that certain items are strictly prohibited from the venue premises, including but not limited to weapons, illegal substances, professional recording equipment, large bags, and any other items deemed unsafe, inappropriate, or in violation of venue policies by the Presenter or venue management. A comprehensive list of prohibited items shall be made available on the Presenter’s social media platforms and at the venue. The Presenter reserves the right to amend this list at any time without prior notice. The Ticket Holder agrees to comply with all prohibitions and acknowledges that any violation may result in immediate removal from the venue and/or legal action.
  7. Sponsorships and Advertising
    1. The Ticket Holder acknowledges and agrees that the Presenter reserves the right, at its sole discretion, to display sponsorships, advertisements, or promotional materials throughout the venue and during the event. The Ticket Holder’s attendance at the event constitutes their irrevocable consent to the display of such materials and waives any claims or objections thereto. The Presenter shall not be liable for any claims, damages, or losses arising from the display of sponsorships, advertisements, or promotional materials.
  8. Charity and Fundraising
    1. In the event that the Presenter engages in charitable partnerships or fundraising efforts in connection with the event, the Ticket Holder acknowledges and agrees to be bound by any additional terms, conditions, or obligations related to such partnerships or efforts. The Presenter makes no representations or warranties regarding the tax deductibility of any charitable contributions or the use of funds raised. The Ticket Holder assumes all risks associated with participating in charitable partnerships or fundraising efforts and hereby releases the Presenter from any claims, damages, or losses arising therefrom.
  9. Assumption of Risk and Limitation of Liability
    1. The Ticket Holder expressly acknowledges and assumes all risks, dangers, and hazards inherent to attending the event, whether occurring before, during, or after the performance, including but not limited to personal injury, property damage, loss, theft, or other harm arising from negligence, or accident of the Presenter, performers, other attendees, or third parties. The Ticket Holder hereby waives, releases, and discharges the Presenter from any and all liability, claims, damages, or losses arising from such risks to the fullest extent permitted by law.
    2. The Presenter shall not be responsible or liable for the actions, statements, or conduct of the performers, including but not limited to any offensive, obscene, illegal, or dangerous content or behavior. The Ticket Holder assumes all risks associated with exposure to such content or behavior and releases the Presenter from any claims, damages, or losses arising therefrom.
    3. The Presenter makes no representations, warranties, or guarantees, express or implied, regarding the quality, content, duration, or subjective satisfaction of the performance. The Ticket Holder acknowledges that the value and enjoyment of the event are inherently subjective and that the Presenter shall not be liable for any disappointment, dissatisfaction, or difference of opinion related to the artistic merits or entertainment value of the show.
    4. To the maximum extent permitted by applicable law, the Presenter’s total liability for any claims, damages, losses, or expenses arising out of or in connection with the event or these terms and conditions, whether in contract, tort (including negligence), strict liability, or otherwise, shall not exceed the face value of the ticket purchased by the Ticket Holder.
  10. Consent to Recording and Release of Publicity Rights
    1. By attending the event, the Ticket Holder hereby grants the Presenter an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, distribute, and publicly display the Ticket Holder’s name, likeness, image, voice, or other recognizable representation as captured in any photographs, videos, or recordings made during or in connection with the event, for any purpose, including but not limited to advertising, promotion, archival, or commercial exploitation, without further consent, notice, or compensation.
    2. The Ticket Holder hereby waives, releases, and discharges the Presenter, its employees, agents, contractors, and affiliates from any claims, demands, or causes of action arising from the use of such photographs, videos, or recordings, including but not limited to claims of defamation, invasion of privacy, right of publicity, or copyright infringement.
  11. Venue Access and Conduct Policies
    1. The Ticket Holder agrees to comply with all rules, regulations, policies, and instructions of the Presenter and the venue, as may be posted, announced, or otherwise communicated before, during, or after the event. Such rules may include, but are not limited to, security screenings, prohibited items, dress codes, and standards of conduct.
    2. The Presenter reserves the right, at its sole discretion and without refund, to deny entry or remove any Ticket Holder from the event for any reason, including but not limited to intoxication, disorderly conduct, safety concerns, or failure to comply with venue policies or the instructions of the Presenter’s staff or security personnel.
    3. The Presenter reserves the right to search the Ticket Holder’s person, belongings, and immediate surroundings for prohibited items, which may be confiscated or result in the Ticket Holder being denied entry or removed from the event without compensation. The Ticket Holder consents to such searches and waives any related claims against the Presenter.
  12.  Intellectual Property and Unauthorized Recording
    1. The Ticket Holder acknowledges and agrees that all intellectual property rights related to the event, including but not limited to trademarks, service marks, logos, copyrights, and patents, are the exclusive property of the Presenter, its licensors, or the performers, as applicable. The Ticket Holder shall not use, reproduce, distribute, or create derivative works based on such intellectual property without the express written permission of the owner.
    2. The Ticket Holder shall not record, photograph, stream, broadcast, or otherwise capture any portion of the performance in any medium or format without the express written consent of the Presenter. Any unauthorized recording or transmission of the event may constitute copyright infringement and may result in legal action, ejection from the venue, and the confiscation or deletion of any recordings or devices used in violation of this policy.
  13. Data Privacy and Electronic Communications
    1. The Presenter collects, processes, and stores the personal data of Ticket Holders in accordance with its Privacy Policy, which is available on the Presenter’s website and is hereby incorporated into these terms and conditions by reference. By purchasing a ticket and attending the event, the Ticket Holder acknowledges that they have read, understood, and agree to the terms of the Privacy Policy.
    2. The Ticket Holder consents to the collection, use, and processing of their personal data by the Presenter for the purposes of event organization, management, and communication, as well as for any other purposes described in the Privacy Policy. The Presenter shall handle personal data in compliance with applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) in the European Union, the California Consumer Privacy Act (CCPA) in the United States, and other relevant state, federal, or international privacy laws.
    3. The Ticket Holder acknowledges that the Presenter may use their personal data, including email address and telephone number, to send marketing communications related to future events, promotions, or other offerings that may be of interest to the Ticket Holder. However, the Ticket Holder has the right to opt out of such marketing communications at any time by following the unsubscribe instructions provided in the communication or by contacting the Presenter’s data protection officer.
    4. If the Ticket Holder wishes to exercise their rights under applicable data protection laws, including the right to access, rectify, erase, or restrict the processing of their personal data, or to object to the processing of their personal data for marketing purposes, they may contact the Presenter’s data protection officer using the following email address:

  1. For Ticket Holders residing in the European Economic Area (EEA), the United Kingdom, or Switzerland, the Presenter shall comply with the requirements of the GDPR, including the appointment of a Data Protection Officer (DPO) and the implementation of appropriate technical and organizational measures to ensure the security of personal data. Ticket Holders in these jurisdictions may also have the right to lodge a complaint with their local supervisory authority if they believe their rights under the GDPR have been infringed.
  2. For Ticket Holders residing in California, the Presenter shall comply with the requirements of the CCPA, including providing clear and conspicuous notice of the categories of personal information collected and the purposes for which it will be used. California residents may also have the right to request access to or deletion of their personal information, as well as the right to opt out of the sale of their personal information, if applicable.
  3. The Presenter shall make commercially reasonable efforts to respond to data privacy inquiries and requests within the timeframes required by applicable law. In some cases, the Presenter may require additional information from the Ticket Holder to verify their identity before processing their request.
  4. The Presenter shall retain personal data only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. The Presenter shall securely delete or anonymize personal data once it is no longer needed, in accordance with its data retention policies and applicable law.
  5. In the event of a data breach involving personal data, the Presenter shall notify affected Ticket Holders and the relevant supervisory authorities within the timeframes required by applicable law. The Presenter shall also take appropriate measures to mitigate any potential harm resulting from the breach.
  1. Health and Safety Protocols 
    1. The Presenter reserves the right to implement health and safety protocols in accordance with public health guidelines, including but not limited to health screenings, proof of vaccination or negative test results, mask-wearing requirements, and social distancing measures.
    2. The Ticket Holder agrees to comply with all health and safety protocols implemented by the Presenter or the venue. Failure to comply may result in denied entry or removal from the event without a refund.
  2. Age Restrictions
    1. The Event may be subject to age restrictions, and the Ticket Holder must meet the minimum age requirement to attend. 
  3. Accessibility
    1. The Presenter and the venue will provide reasonable accommodations and accessibility services to Ticket Holders with disabilities. Ticket Holders should contact the Presenter or the venue in advance to request any necessary accommodations.
    2. Service animals may be permitted in accordance with applicable laws and venue policies. Ticket Holders should contact the Presenter or the venue for specific guidelines on service animals.
  4. Code of Conduct
    1. The Ticket Holder agrees to adhere to the code of conduct set forth by the Presenter and the venue, which includes but is not limited to refraining from disruptive, offensive, or violent behavior. Violations of the code of conduct may result in removal from the event without a refund.
    2. The Presenter and the venue maintain a zero-tolerance policy for harassment, discrimination, and violence. Any Ticket Holder found engaging in such behavior will be immediately removed from the event and may be subject to legal action.
  5. Emergency Procedures
    1. In the event of an emergency, the Ticket Holder agrees to follow the evacuation procedures and instructions provided by the Presenter, venue staff, or emergency personnel.
    2. Emergency contact information and the location of first aid services will be available at the venue. The Ticket Holder should familiarize themselves with this information upon arrival.
  6. Merchandise and Concessions
    1. All sales of merchandise at the event are final, and refunds or exchanges will only be provided in accordance with the policies set forth by the Presenter or the merchandise vendor.
    2. Outside food and drinks are prohibited, and the Ticket Holder may not bring such items into the venue. The Presenter and the venue reserve the right to confiscate any prohibited items.
  7. Weather Policy
    1. For outdoor events, the Presenter reserves the right to cancel, postpone, or modify the event due to adverse weather conditions. Refunds or exchanges due to weather-related cancellations will be handled in accordance with the Ticket Vendor’s terms and conditions.
  8. Force Majeure 
    1. The Presenter shall not be liable for any failure or delay in the performance of its obligations under these terms and conditions arising out of or caused by, directly or indirectly, forces beyond its reasonable control, including but not limited to strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes, acts of God, and interruptions, loss, or malfunctions of utilities, communications, or computer services.
  9. Feedback and Complaints
    1. The Ticket Holder may submit feedback, complaints, or concerns related to their event experience to the Presenter using the contact information provided on the Presenter’s website. The Presenter shall make commercially reasonable efforts to address and resolve any submitted concerns in a timely manner. In the event of a dispute between the Ticket Holder and the Presenter, the parties agree to engage in good-faith negotiations to resolve the dispute. If the parties are unable to resolve the dispute through informal negotiations, they agree to submit the dispute to mediation before a mutually agreed-upon mediator. If mediation fails, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the [Insert Arbitration Jurisdiction]. The prevailing party in any arbitration proceeding shall be entitled to recover reasonable attorneys’ fees and costs.
  10. Governing Law, Jurisdiction, and Dispute Resolution
    1. These terms and conditions shall be governed by, construed, and enforced in accordance with the laws of Hong Kong, without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any other jurisdiction.
    2. Any dispute, claim, or controversy arising out of or relating to these terms and conditions, the event, or the relationship between the parties shall be resolved exclusively through binding arbitration conducted in accordance with the rules of the Hong Kong International Arbitration Centre (HKIAC) in Hong Kong. The arbitrator’s decision shall be final, binding, and non-appealable, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
    3. Notwithstanding the foregoing, the Presenter shall have the right to seek injunctive or other equitable relief in any court of competent jurisdiction in Hong Kong to prevent or enjoin any breach or threatened breach of these terms and conditions or any infringement of its intellectual property rights.
  11.  Severability and Integration
    1. If any provision of these terms and conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these terms and conditions and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
    2. These terms and conditions, together with any documents incorporated herein by reference, constitute the entire agreement and understanding between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, or understandings, whether written or oral.
  12. Updates and Amendments
    1. The Presenter reserves the right, at its sole discretion, to update, modify, or amend these terms and conditions at any time without prior notice. The most current version of the terms and conditions shall be made available on the Presenter’s website. The Ticket Holder’s continued attendance at the event following any modifications shall constitute their acceptance of the revised terms and conditions. It shall be the Ticket Holder’s responsibility to periodically review the terms and conditions for any updates or changes.
  13. Language and Interpretation
    1. These terms and conditions are drafted in the English language, which shall be the controlling language for all purposes. Any translations provided are for informational purposes only and shall not be legally binding. In the event of any discrepancies, inconsistencies, or ambiguities between the English version and any translated version, the English version shall prevail and control.

By purchasing a ticket, attending the event, or otherwise manifesting assent to these terms and conditions, the Ticket Holder acknowledges that they have read, understood, and agreed to be bound by all of the terms, conditions, and provisions contained herein. The failure of the Presenter to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.
